The Personal Injury Window

Having recently relocated to the third floor of BTMK’s offices at 19 Clifftown Road I am now enjoying the benefits of the much improved view from my office window. Looking through this gives me an opportunity to reflect on what seems to be the ever changing landscape for personal injury lawyers and their clients. This is the first of what will be a regular series of comment articles designed to let you look through the window at what we are up to and what you may be facing.

The news agenda is of course currently dominated by Brexit. As injury lawyers we have to be aware of the impact which this may have on personal injury claims. For example will there now be some dilution of the rights of those injured at work? What about drivers? A committee of MPs has now recognised that there will be changes post-Brexit on how UK drivers can claim compensation when injured in the European Economic Area and have recommended that this should be debated by Parliament. Developments in this area will be of importance to the considerable numbers who enjoy motoring whilst on holiday in Europe (including myself although “enjoy” may not be the right word for me!!).

On the home front:

Just before Christmas we were pleased to achieve a substantial settlement for a client who suffered life changing injuries as a consequence of a road traffic accident. A case study is being prepared but in the meantime we are delighted that with the care and support which he has been given the client has regained significant independence and is now set up with a new home.

I am proud to be the Chair of the Essex Acquired Brain Injury Forum the aims of which are to raise awareness of acquired brain injury across Essex and to campaign fpr better services for survivors and their families. After some reduced activity 2018 we started the new year with a steering group meeting on the 23rd January and further details on this and on brain injury developments generally will feature in future articles.
